Safety Barrier Inspections

In South Australia it is a requirement that when selling your home and there is a swimming pool on the property, the swimming pool safety barrier must either;

  • comply with the rules that were in place when the pool or safety barriers were approved

or

  • be in line with Ministers Specification SA76D – Swimming Pool Safety – new prescribed requirements for upgrading prescribed swimming pools.

Why do I need
a Compliance Certificate?

Whilst there is no legal requirement in South Australia for pool owners to obtain a compliance certificate, it makes good sense to have your pool safety barrier assessed by an expert so that you can be assured that your safety barrier complies with the required Australian Standards and South Australian Legislation, reducing the risk of small children accessing your swimming pool area.

When selling your home, a compliance certificate can provide potential purchasers comfort and surety in knowing that the current pool safety barrier complies with the relevant Australian Standards and South Australian Legislation.

Safety Barriers

Safety barriers are required by legislation for any pool or spa with water in excess of 300 mm in depth, and must be in place before the pool or spa is filled. The key elements of the relevant Australian Standard (AS 1926.1, 1926.2 and 1926.3) are designed to deny access by unsupervised young children (especially those under 5 years of age) to the swimming pool area.

It is your responsibility as the owner, in making sure that current requirements for swimming pool safety are met. Generally speaking, having proof in writing, such as a certificate of compliance would be advisable. Such proof provides peace of mind for all parties concerned in the sale of a property.
The sides of an above-ground pool can be accepted as being part of a pool safety barrier, provided they comply with the Australian Standard 1926.1, however a barrier must also be provided around the ladder (it’s not good enough to say the ladder will be removed when an adult is not present) as well as pipes, pumps or anything else that can be climbed on.
Even without water, a pool or a spa is still a pool or a spa.
